Terms and Conditions established by Exotic Diamonds & Jewelry Each lot in this catalogue is offered subject to the following Terms and Conditions of Sale, as supplemented in writing or otherwise by us at any time prior to the sale. By registering to bid at the auction, or by placing a bid through any means, you agree to be bound by these Terms and Conditions of Sale. In these Terms and Conditions of Sale, "we," "us," "our," ? Exotic Diamonds & Jewelry? or similar terms mean Exotic Diamonds & Jewelry. and any of its agents, and "you," "your," "buyer" or similar terms mean a person bidding on or buying. Lots are available for preview 24-48 hours prior to the first day of the entire auction event, please know that our items are hand pick and crafted by master Jeweler. Please register in priority to participate in our live auction event. Thank you for participating in our auction. COMPLETE AGREEMENT AND BINDING AGREEMENT The Terms and Conditions (which for all purposes include the Conditions of Sale) contain all of the provisions applicable to the agreement between Exotic Diamonds & Jewelry, on the one hand, and each bidder and Buyer, on the other, with respect to the subject matter of the Terms and Conditions. The provisions of the Terms and Conditions supersede and extinguish all other agreements, representations or understandings, whether prior or contemporaneous, oral or written, between the parties concerning that subject matter. These Terms and Conditions shall be binding on Buyer's heirs, beneficiaries, executors, and successors and permitted assigns. BUYER'S PREMIUM All items are subject to a 15% Buyer's Premium. The Buyer's Premium is a fee traditionally charged by auction houses on the sale of fine goods. It is added to the winning bid price and is paid by the buyer as part of the total sale price. More specifically, auctioneers collect a premium to pay for their services (e.g. hosting a live auction event, advertising, authenticity guarantees, storage, and handling of merchandise). PAYMENT METHODS We accept all mayor credit cards & cashier?s checks and money orders .We do not use pay pal .If you are a winner in one of our auctions, you will receive an email with checkout instructions and a checkout link. NON-PAYING BIDDERS By bidding, you agree to our terms & conditions. If payment is not received within 7 calendar days after the close of the auction, your right to the item may be forfeited. We reserve the right to report an Unpaid Item Dispute, which may result in your indefinite suspension from Ebay SALES TAX Unless exempted by law, the Buyer is required to pay California State Sales Tax of 8.25% (if located within California) and any compensating use tax of another state, And/or any federal luxury or other tax, on the total purchase price including the Buyer's Premium. REFUND AND RETURNS POLICY Simply return within 7 days after receipt to the address on your packing slip/receipt via an insured and track able method such as, USPS, UPS or FedEx. Properly pack the merchandise and include jewelry tag, copy of the receipt. Merchandise must be returned in its original condition. There will be 3% restocking fee for any return items. Refunds are generally made within 14 Business days (excluding weekends & holidays). SHIPPING & HANDLING Please refer to the link in our ad for shipping costs. Bidders outside the continental USA must contact us for shipping rates and availability prior to bidding. We are happy to combine orders for you if you check out at one time within a 5-day period. Insurance will be included for all shipments. If you have any questions about insurance & shipping costs, please contact us before bidding. Shipping to P.O Boxes is prohibited. Please provide us with a physical residential or business address for delivery. You can generally expect to receive your item(s) within 7 to 14 Business Days (Excluding Weekends & Holidays) after you complete the 'check out' process and your payment is confirmed. Once your item is sent, you will receive a shipment confirmation. DISPUTE RESOLUTION Should a dispute occur between Exotic Diamonds & Jewelry and Buyer (the parties) that cannot be resolved, then the parties agree to the rules, regulations and procedures of the dispute resolution described below and agree to the following procedures for Resolution of the Dispute: If either party alleges that the other party is in default under this agreement, then the dispute or allegation shall be submitted for Binding resolution to In House Attorneys, P.C. in the City of Los Angeles, California. Each party shall simply present their own case (limited to a maximum of one hour for each party) to In House Attorneys, P.C., excluding witnesses, expert witnesses and attorneys. The parties agree and acknowledge that they are completely waiving their rights to have the dispute heard in a conventional manner including the use of attorneys, arbitration, mediation and any civil court in California having jurisdiction over the dispute. Any award determined by In House Attorneys, P.C. shall be binding and the prevailing party shall be awarded full reimbursement of its actual paid fees in connection with the dispute for the dispute remedy listed herein. FEEDBACK If you leave Negative or Neutral Feedback against us and we do not agree, then you automatically and irrevocably agree to consent to Square Trade to resolve the feedback Dispute. If you fail to comply with Square Trades request to mediate, then you automatically and irrevocably agree to arbitration (as described under this Provision and the Dispute Resolution provision below) to hear the Negative or Neutral Feedback dispute, with the final result rendered by an arbitrator being binding between the parties. Any arbitration award may be entered into a court of law and a Judgment may be rendered by the court empowering/instructing EBay to completely remove the Negative or Neutral Feedback comments. A judgment rendered by the court May also include monetary damages. If you fail to submit to Arbitration, you will automatically be in default and the arbitrator may proceed with the arbitration and enter an award in your absence. Item descriptions only represent an estimated opinion by the Consignor(s), Gemological Laboratories and in no way or case shall Exotic Diamonds & Jewelry or its Consigner(s) be held responsible for any inaccuracies or differences which could occur by examination of the item by other Gemological Laboratories or other experts in the field of grading gemstones and jewelry. Exotic Diamonds & Jewelry or its Consignor(s) is not responsible for errors and omissions in the description, glossary, or any supplemental material. Buyer agrees to hold Exotic Diamonds & Jewelry harmless from any and all liability arising from Exotic Diamonds & Jewelry; it’s appointed officials, members, employees, auctioneer, the company and its agent and employees, the event organizers, sponsors and or volunteers in connection with this auction. LIMITATION OF LIABILITY Our liability to a Buyer will not in any case exceed the purchase price actually paid for an item. Exotic Diamonds & Jewelry shall not be liable for any breach or default of a consignor. Exotic Diamonds & Jewelry liability for any breach, or act or omission cannot exceed the purchase price actually paid by the Buyer, and Exotic Diamonds & Jewelry shall not have any liability under any circumstances for special, indirect, incidental or consequential damages (including for loss of profits or revenue, costs of obtaining alternative property, claims of customers of Buyer or otherwise), whether in contract, tort, negligence, strict liability, or otherwise, arising out of, resulting from or in any way relating to the item or its purchase, sale, delivery or non-delivery, or the acts or omissions of Exotic Diamonds & Jewelry or Exotic Diamonds & Jewelry agents, representatives, officers, members, managers, directors, employees and/or affiliates. SEVERABILITY If any provision or portion thereof of the Conditions of Sale shall be void, unlawful or unenforceable under applicable law, that provision or portion thereof shall be deemed deleted and severed from the remaining provisions, and shall not affect the enforceability or validity of any of the remaining provisions. NO ASSIGNMENT Absent written consent from Exotic Diamonds & Jewelry, Buyers may not assign their rights or any of their obligations relating to an auction or other sale by Exotic Diamonds & Jewelry. Any assignment without Exotic Diamonds & Jewelry written consent will be void. A waiver shall not be effective unless it is in writing and signed by the party alleged to have given the waiver. A waiver on one occasion by Exotic Diamonds & Jewelry shall not be a waiver on any other or future occasion or affect Exotic Diamonds & Jewelry right to insist on strict performance of all other provisions.
